In order to be able to continue to consider the property rented to the tenant as decent, the owner must take care of, in general, the most expensive work. As for the tenant, he takes care of the routine maintenance work.

The owner's obligation

It is mandatory for the owner to deliver at the time of entry of the tenant's premises a decent housing in good condition, in terms of lighting, ventilation or surface and many other parameters are taken into account. The entire DDT (Technical Diagnostics File) must be given to the tenant before he enters the premises in order to inform him about the condition of the accommodation and to avoid potential future disputes. Otherwise, claims for repairs or work obligations on the part of the owner may be required at the time of entry into the premises by the tenant. Thereafter the owner will have to pay for potentially large repairs so that the habitat is decent.

To another extent, by mutual agreement between the landlord and the tenant, it is possible for the latter to take charge of the work and obtain a temporary exemption from rent. To do this, in the lease agreement must include a specific clause concerning this subject, clause to specify that the tenant will carry out the work with the exemption registered accordingly.

What work does the tenant have to take care of?

Despite a large number of works incumbent on the owner, the tenant has the obligation of the routine maintenance of the dwelling, minor repairs and equipment made available to him. In general, repairs are less substantial than those borne by the owner, being more expensive, however they remain essential in order to avoid a rapid deterioration of the housing.

The work taken care of by the tenant is detailed in the decree of August 26, 1987, the most common are the replacement of fuses and switches, maintenance of plumbing, heating, electrical installation and paint fittings. It is still possible for him to carry out work on his own initiative in order to improve his personal comfort while remaining only simple arrangements such as parquet or painting. The authorization of the owner will be necessary in case of major transformation such as the destruction of a partition.

What work does the owner have to take care of?

When renting, as mentioned above, the owner must ensure the decency of the rented accommodation and therefore take care of multiple improvements or repairs in order to meet the safety and comfort criteria established by law. At the request of the tenant or on his own initiative, he must take charge of the work aimed at repairing the damage caused by the natural wear and tear of the property. Similarly, the work of upgrading to standards must be borne by him, as for the kitchen area, the carpentry or for the construction materials, as well as the possible replacement of radiator or boiler.

However, the owner is absolutely not obliged to take care of the work being the consequence of misuse or lack of maintenance on the part of the tenant.
